Terms of Use
The short version
Cartemark compares a menu you give it with menus venues publish on their own websites. These terms are the agreement between you and us for using it.
- The answers are statistics, read from published menus by software that includes AI. They can be incomplete, out of date or misread. They are information, not advice: you decide your own menu and prices.
- Use the answers for your own business as you like. Do not scrape the market, resell it, or use it to work out which venues are in it.
- The menu you give us stays yours. We use that copy only to answer you, and never add it to the market. If your venue publishes its menu online, the market may already hold a separate copy, read from your website; a venue can ask us to remove it.
- Pro is billed monthly in advance and you can cancel any time; it runs to the end of the month you paid for. We give at least 30 days' notice of a price change.
- Your rights under the Australian Consumer Law always apply, whatever these terms say.
1. Who we are, and agreeing to these terms
Cartemark (the website at cartemark.lotlsoft.com, its HTTP API and its MCP server for AI assistants) is run by Lotlsoft, a sole trader in Victoria, Australia, ABN 83 788 058 281, registered for GST. "We", "us" and "our" mean Lotlsoft. "You" means the person using Cartemark and, if you use it for a business, that business too. If you use Cartemark for a business, you confirm you are allowed to agree to these terms for it.
By using Cartemark, or by creating an account, you agree to these terms. If you do not agree, please do not use it. You must be 18 or older to create an account or subscribe.
2. What Cartemark is, and what it is not
Cartemark compares a menu you give it with menus that venues publish on their own websites. It tells you what the market carries that you do not, where your prices and size sit, and what you have that no other menu does.
It is information, not advice. Nothing in Cartemark is financial, business, legal, tax, nutrition or food-safety advice. It says what the market does, never what you should do: a dish can be off a menu for good reasons, and a price can be right for your kitchen and your customers whatever the market says. You decide your own dishes and prices, and you are responsible for what you decide. Check anything that matters before you act on it.
Diet labels are not allergen information. Where Cartemark reports vegetarian, vegan or other diet labels, they come from what menus print or from an automated reading of them. Never rely on Cartemark for allergen or dietary statements on your own menu.
3. The market and its answers
The market is made of menus venues publish on their own websites, and archived copies of them, read into dishes and prices. Answers about it are statistics: medians, ranges and shares.
- Every answer says how many menus it rests on. That can be as few as one. A figure from three menus is weaker than one from three hundred; weigh it accordingly.
- Reading is automated, and can be wrong. Menus, and the menu you give us, are read by software that includes AI models. It can miss a dish, misread a price, put a dish in the wrong section or match two different dishes. Check what we read from the menu you gave us on the report before relying on it.
- The market can be incomplete or out of date. We hold the menus we have been able to read, as they were when we read them. Venues change their menus and prices, and many do not publish one. The market is not a survey of every venue in an area.
- The kind of place is a suggestion. When you do not say what kind of place yours is, Cartemark suggests one from the menu you gave it, for you to confirm. A wrong choice gives a less useful comparison.
If you find something wrong, tell us and we will look at it.
4. Accounts, API keys and connected assistants
You can use Cartemark without an account. To save menus, subscribe to Pro, create API keys or connect an AI assistant you need one. Sign-in runs through Lotl Auth, our account service. Give a real email address and keep your password to yourself.
Treat API keys and connected assistants like your password. Anyone holding one of your keys, and any assistant you connect, can use Cartemark as you, including your Pro access. A key is shown once: do not share it or put it anywhere public, such as code others can see. You are responsible for what is done with your account, your keys and the assistants you connect, except where it happens because we failed to keep them secure.
If you think a key or connection has been misused, revoke it on your account page and tell us. We may revoke a key or disconnect an assistant if we reasonably believe it has been compromised or misused, and we will tell you when we do.
One business per subscription. A Pro subscription is for you and your own business, including its staff and its venues. Using one subscription to provide answers to other businesses, for example as a consultant or agency, needs our written agreement first.
5. Acceptable use
Cartemark exists because venues publish their menus for the public and trust that they are not being watched one by one. These rules protect that, and the service. You must not:
- Extract the market. Scrape, crawl, bulk-download or systematically collect market data through the website, the API, the MCP server or any other way, including by running many queries to rebuild its figures. Ordinary use within your allowance is fine.
- Resell or redistribute it. Sell, license, publish or share market data or answers in bulk, or use them to build or train a dataset, product or model that offers menu or price data to others or competes with Cartemark.
- Identify venues. Try to work out which venue or venues an answer rests on, or reconstruct a venue's menu or prices, for example by narrowing a slice or comparing many slices. Do not present an answer as being about a named venue.
- Get around limits. Avoid allowances, rate limits, plan restrictions or security measures, open extra accounts to get more allowance, or share Pro access outside your business.
- Give us what is not yours to give. Give us a menu you do not have the right to use. Give us your own menu, a menu you are writing, or a menu of a business you work for or advise with its permission.
- Harm the service. Overload it, probe or test its security, send malware, interfere with other people's use, or copy, decompile or reverse engineer it, except where the law allows that and it cannot be excluded. If you find a security problem, please report it to security@lotlsoft.com.
- Break the law or mislead. Use Cartemark unlawfully, infringe anyone's rights, or suggest that we endorse you or your business.
Fair use. Reading a menu costs us money, so there is an hourly allowance of menu readings, larger when you are signed in, and limits on how fast the API and MCP server answer. We set and adjust these to keep Cartemark working for everyone. These rules apply equally to anything acting for you, including an AI assistant or your own scripts.
7. Our content, and what you may do with answers
Cartemark's software, design, name and logo, the market as we have compiled it (the menus we have read from venues' own websites and the dishes, prices and facts we read from them), our dish matching, and the reports and answers Cartemark produces belong to us or the people we license them from. We do not claim a venue's rights in its own menu; what we claim is our compilation and our readings.
While you follow these terms, we give you a non-exclusive, non-transferable licence to use Cartemark and its answers for your own business. You may keep, print and share answers within your business and with your advisers, quote figures from them (for example to a lender, landlord or business partner), and use them to set your menu and prices. You do not need to credit Cartemark. You may keep using answers you received while these terms applied after you stop using Cartemark, within the limits of section 5.
Some place data comes from OpenStreetMap, © OpenStreetMap contributors, available under the Open Database License.
If you send us feedback or suggestions, we may use them without owing you anything for them.
8. AI assistants and other apps
You can use Cartemark from an AI assistant (such as Claude or ChatGPT) or your own tools, through the MCP server or the HTTP API. When you connect one, it acts for you: requests it sends with your connection or key are treated as yours, within the access you approved.
Those assistants are run by other companies under their own terms and privacy policies. What you send them, and what they do with Cartemark's answers, is between you and them. An assistant gets the same answers you would see in Cartemark, but it may summarise, shorten or misstate them, and we are not responsible for what it says or does with them. When an answer matters, check it in Cartemark. You can disconnect an assistant at any time from your account page.
9. Free and Pro
Reading a menu you give us and the menu analysis are free and need no account. Pro adds your market position, comparisons against slices you choose, your prices dish by dish and dish price lookups. The pricing page says what each plan includes; that can change under section 11.
We sometimes give Pro free of charge, for example to test it or to say thank you. Complimentary Pro can end, and we will tell you before it does.
10. Pro billing, renewal and cancelling
- Price. Pro costs the price shown on the pricing page when you subscribe, in Australian dollars, including GST where it applies. It is A$20 a month today. We do not promise that price will stay the same; see price changes below.
- Payment. Payments are taken by Stripe through Lotl Pay, our payment service. Stripe's terms and privacy policy apply to the card details you give at checkout; we never see your full card number.
- Renewal. Pro is billed monthly in advance and renews automatically each month until you cancel.
- Cancelling. Cancel any time with Manage billing on your account page. You will not be charged again, and Pro stays on until the end of the month you have paid for. After that your account returns to the free plan and your saved menus stay.
- Refunds. We do not refund part of a month when you cancel, or a month you did not use, except where the Australian Consumer Law or these terms (sections 11, 13 and 18) say otherwise. Nothing here limits your rights to a refund under the law.
- Price changes. We will email you at least 30 days before a new price applies to you. It applies from your first renewal after those 30 days. If you do not want to pay it, cancel before then and you will not be charged it.
- Failed payments. If a payment does not go through, your account page says so and asks you to update your card, and Stripe tries again. If it still cannot be paid, Pro ends and your account returns to the free plan.
- Tax invoices. We issue tax invoices for Pro payments. If you need one you have not received, email billing@lotlsoft.com.
- Billing problems. If a charge looks wrong, please email billing@lotlsoft.com first and we will sort it out quickly. This does not affect any right you have with your bank or card issuer.
11. Changes to Cartemark
We keep improving Cartemark, so features, the cuisines and areas the market covers, allowances and the way answers are worded will change. Features marked as new, early or in testing may change or be removed without notice.
If we remove or substantially reduce a Pro feature, or stop offering Pro, we will tell you at least 30 days beforehand where we reasonably can. If the change matters to you, you can cancel and we will refund the unused part of the month you paid for.
12. Availability
We work to keep Cartemark running and fix problems quickly, but we do not guarantee it will always be available, fast or free of errors. It may be unavailable for maintenance, or because a service it depends on (hosting, AI models, payments) fails. Keep your own copy of any menu you give us, and anything else you cannot do without.
13. Suspension and ending
You can stop using Cartemark at any time. Delete account on your account page deletes your Cartemark subscription record, saved menus, connected assistants and API keys. Cancel Pro first, with Manage billing on the same page.
We may suspend or end your access (your account, a key, a connection, or access from an address) if you seriously or repeatedly break these terms, or if we need to in order to protect Cartemark, other people or the venues in the market, or to comply with the law. Where it is reasonable, we will tell you first and give you a chance to fix the problem. For a serious breach of section 5, such as scraping or an attack, we may act straight away.
- If we end your access because you broke these terms, we do not refund the rest of the month, except where the law requires.
- If we end your access for any other reason, or close Cartemark, we will give you at least 30 days' notice where we reasonably can and refund the unused part of any month you paid for.
Sections 5, 7, 15, 16, 17, 20 and 21 keep applying after these terms end, as far as they are relevant.
14. Venues in the market
The market is built from menus venues publish on their own websites. We read them politely: we follow each site's robots.txt, fetch at most one page a second from a site, and never take menus from ordering platforms or their apps. No venue is ever named, listed or shown on its own.
If you run a venue and want its menu corrected, or taken out of the market, tell us or email hello@lotlsoft.com with the venue and its website. We will check the request comes from the venue and then remove its menu from the market, so that no answer uses it. Removal is by request: giving us a menu, or deleting a saved menu or an account, does not remove a venue's menu from the market.
15. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or changed.
Where the law allows us to limit our liability for failing to meet a consumer guarantee (for example because Cartemark is not a service ordinarily acquired for personal, domestic or household use), our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.
16. Limits on liability
Subject to section 15, and as far as the law allows:
- Apart from the guarantees the law gives you, Cartemark is provided as it is, and we do not promise that its answers are complete, accurate, current or suited to your purpose.
- Neither of us is liable to the other for indirect or consequential loss, or for loss of profit, revenue, goodwill or business opportunity. For us, that includes loss from menu or pricing decisions made using Cartemark.
- Our total liability to you for all claims about Cartemark is limited to the greater of the amount you paid us for Cartemark in the 12 months before the claim arose, and A$100.
- Our liability is reduced to the extent that you, someone acting for you (including an AI assistant you connected), or a third party caused or contributed to the loss.
These limits do not apply to liability for fraud or wilful misconduct, to your liability for a deliberate breach of section 5, or to anything else the law does not allow to be limited.
17. Claims caused by misuse
If someone else makes a claim against us because you gave us content you had no right to give, or because you broke section 5, you will cover the reasonable costs and losses that result for us. This is reduced to the extent that we caused or contributed to them. We will tell you promptly about any such claim and give you a reasonable chance to have your say in how it is handled.
18. Changes to these terms
We may update these terms. The version number and date at the top always show which version is current.
- If a change materially reduces your rights or adds to what you pay, we will email account holders and post the new terms at least 30 days before it takes effect. If you do not accept it, you can cancel before then and we will refund the unused part of any month you paid for.
- Other changes, such as clearer wording, terms for a new feature, or changes the law requires, take effect when we post them.
If you keep using Cartemark after a change takes effect, the new terms apply. Ask us for an earlier version at any time.
19. Privacy
Our privacy policy explains what we hold about you and about the venues in the market, why, and for how long. It forms part of these terms.
20. Disputes and governing law
If something goes wrong, please tell us first at hello@lotlsoft.com, and we will both try in good faith to sort it out within 30 days. That does not stop either of us seeking urgent relief from a court, or you contacting a regulator such as Consumer Affairs Victoria or the ACCC.
These terms are governed by the law of Victoria, Australia. Both of us submit to the non-exclusive jurisdiction of the courts of Victoria and the federal courts sitting in Victoria.
21. General
- Whole agreement. These terms, the privacy policy and the price shown when you subscribed are the whole agreement between us about Cartemark.
- If part is invalid. If a court finds part of these terms unenforceable, that part is read down as little as needed, or removed, and the rest still applies.
- No waiver. If either of us does not enforce a term straight away, that does not give up the right to enforce it later.
- Transfer. You may not transfer your account or these terms to someone else without our agreement. We may transfer them to whoever takes over Cartemark, as long as your rights under them are not reduced, and we will tell you if we do.
- Events outside our control. We are not responsible for a delay or failure caused by something we could not reasonably control, such as an outage at a provider we depend on.
- Notices. We send notices to the email address on your account. You can send notices to hello@lotlsoft.com.
- Examples and headings. Examples in these terms ("for example", "such as") illustrate a rule and do not narrow it. Headings and the short version are for reading ease; the numbered sections are the terms.
22. Contact
Questions about these terms, or anything else: hello@lotlsoft.com, or Feedback at the bottom of any Cartemark page. Billing: billing@lotlsoft.com. Security: security@lotlsoft.com.
